    This document (together with all the documents mentioned herein) sets out the terms and conditions governing the use of this website – www.itg.ro (hereinafter referred to as the “Website”).

    The purpose of the Website is to present and promote professional IT services/solutions for optimizing work processes (through technology integration and digitization of related operations) in industries such as retail, HoReCa, transport, logistics, manufacturing, pharma and healthcare, education, banking, and other sectors – provided by IT Genetics S.A., and for contracting, via the Website, with potential clients interested in these services/solutions.

    Please read these Terms and Conditions, the Cookies Policy, and the Privacy Policy before using the Website. By accessing and using the Website, you expressly acknowledge the binding nature of these documents and commit to complying with them.

    1. Who are we?
    IT Genetics S.A. (hereinafter referred to as the “Company”) is a technology provider that supports companies in Romania, Hungary, Bulgaria, and Spain in optimizing their work processes through technology integration and digitizing their operations with the help of professional IT solutions.

    Founded in 2007, IT Genetics has taken on the mission of making technology accessible to all companies, regardless of their nature and size. We have over 16 years of expertise in integrating solutions for retail, HoReCa, transport, logistics, manufacturing, pharma and healthcare, education, banking, and other industries.

    IT Genetics solutions are designed to optimize and automate work processes, and each solution developed by the company is customized according to the client’s specifics and absorption potential. We are a company with a global approach, and we know how to work with the businesses in our portfolio to ensure that any solution implemented is efficient, helping to achieve greater results with less effort.

    2. Intellectual Property
    The Company is the exclusive owner of all intellectual property rights related to the content of the Website, including but not limited to: articles, text, photos, illustrations, music, audio and video clips, trademarks, emblems, and designs.

    Website visitors may access, download, and print materials published on the Website free of charge, exclusively for personal use and only for non-commercial purposes. By performing any of these actions, Website visitors do not receive or acknowledge any right, title, or legitimate interest regarding the materials published on the Website.

    No section of the Website’s content, over which the Company has intellectual property rights, may be reproduced, distributed, or published in any form, for any purpose or by any means, without the prior written consent of the Company.

    Therefore, Website visitors declare that by simply using the Website, they understand and agree not to copy, modify, sell, distribute, transmit, display, reproduce, publish, or create works/derivatives based on the information published on the Website.

    3. Terms
    a) Seller / Company – IT Genetics S.A.

    b) Visitor – any individual over the age of 18 or any legal entity interested in the digitization services or customized consulting and technical support solutions offered by the Seller, who has access to the Site’s content.

    c) Client – any individual over the age of 18 or any legal entity who accesses the digitization services or consulting and technical support solutions promoted through the site, through any means of communication provided by the Seller (electronic, phone, etc.), following the completion of contact or business meeting/consultation session forms and subsequent meeting with the Seller’s representatives, resulting in a specific contract between the parties.

    d) Site – the website hosted at www.itg.ro;

    e) Request – a form of communication between the Seller and the Client via the Site, through which the latter conveys to the former their intention to purchase digitization services or consulting and technical support solutions offered by the Seller;

    f) Digitization services/consulting and technical support solutions – any applicable service/solution related to the domains presented on the Site, which will be provided by the Seller to the Client as a result of the Contract concluded between the parties.

    g) Commercial communications / Newsletter – any type of message sent (email, phone, mobile push, web push, etc.) containing general and thematic information, information regarding services/solutions similar or complementary to those purchased from the website, information regarding offers or promotional prices, etc.

    4. Use of the Website
    By using the Website, you agree to:

    a) Not make any false or fraudulent request – for digitization services or consulting and technical support solutions. If we have reasonable grounds to believe that you have made such a request, we reserve the right not to respond to it and to duly inform the competent authorities.

    b) Provide us with your correct and accurate name and surname, an email address, and/or other contact details. If you do not provide us with all the required information, we may not be able to respond to your request.

    By using the Website in any way and for any purpose, you declare that you meet the legal conditions, namely that you have the legal capacity to enter into legal acts that create obligations as stipulated in the Terms and Conditions, the Privacy Policy, and the Cookies Policy.

    The mere use of the Website and/or the submission of a service/solution request – through the contact forms, business meeting/consultation session forms, and the response to this request do not obligate the Company in any way to the visitor/potential Client, nor do they constitute a contract between the Company and the visitor/potential Client.

    Through the Website, the Company invites the visitor and potential Client to contract the services offered. Additionally, the Company recruits personnel in Customer Support, Marketing, Software, and Sales.

    The visitor or potential Client will contact the Company (by filling in contact forms or scheduling a business meeting/consultation session or using any contact details published on the Website and listed under Section 1 of these Terms and Conditions) for negotiations and the conclusion of a service provision contract.

    The respective contract will establish all essential elements for its conclusion according to the law, including specific terms, such as the obligations and rights of the Parties, the price of the contracted services, guarantees, liability, etc.

    5. Limitation of Liability
    The Company is not liable for any damages that the Website visitor, potential Client, or any other third party may suffer as a result of using the Website in any way or purpose or as a result of the Company’s fulfillment of any legal and/or contractual obligations owed to it.

    The visitor will use the services offered through the Website entirely at their own risk. The visitor is responsible for maintaining the confidentiality of information transferred/received through the Website and for processing it in accordance with legal provisions on personal data protection.

    Any type of information provided through the Website is delivered by the Company in the form and content in which it was received or taken, without modifications.

    The Company does not guarantee and does not assume responsibility for the correctness, accuracy, or timeliness of any of this information.

    6. Our Right to Modify the Terms and Conditions
    We reserve the right to review and modify the Terms and Conditions occasionally and at our discretion.

    You are responsible for reading the Terms and Conditions, Cookies Policy, and Privacy Policy in their entirety, as the applicable version will be the updated one in effect at the time of using the Website.

    7. Applicable Law and Jurisdiction
    The use of the Website and the conclusion, execution, and termination of contracts concluded with the Company through the Website will be governed by Romanian law.
    Any disputes arising from or in connection with the use of the Website or the conclusion, execution, and termination of these contracts will be resolved amicably or, if this is not possible, the disputes will be settled by the competent Romanian courts.

    8. Processing of Personal Data
    The processing of personal data by the Company takes place in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“General Data Protection Regulation”) and relevant national data protection legislation.
